Use of the my.petaid.io platform by end users

- 1. Scope
1.1 PetAid-Vet is a service of PetAid GmbH, a company under Austrian law with its registered office in Vienna, registered in the commercial register of the Vienna Commercial Court under FN 552101p (“PetAid”).
1.2 PetAid operates the internet mediation platform my.petaid.io (“Platform”). Via the platform, private individuals who are at least 18 years of age and reside in Austria or the European Union (“Users”) can book an online consultation appointment with a veterinarian (“Veterinarian”) licensed in the European Union. The prerequisite is that the user and his pet are already patients of the respective veterinarian. (Or according to the legal requirements of the respective country)
1.3 These General Terms and Conditions regulate the relationship between PetAid and the user regarding the use of the platform, the arrangement of a veterinary online consultation appointment (“consultation appointment”) and the services offered by PetAid via the platform in this context.
1.4 The veterinarian offers the consultation appointment and the veterinary consultation carried out during this appointment on his own behalf and under his own responsibility. PetAid itself only provides the platform for handling the consultation appointment between the user and the veterinarian. PetAid does not become a party to the treatment contract.
- 2. Subject matter of the contract and functioning of the platform
2.1 Before using the platform for the first time, the user must create a personal user account (“user account”). When the user completes the registration, a contract of use is concluded between the user and PetAid.
2.2 The user can book a consultation appointment online at any time via his user account (“booking module”). To do this, the user enters the name of his veterinarian and the next available appointments for his veterinarian are displayed to him via the platform.
- 3. Selection of Doctors
The veterinarians prove their admission by means of a corresponding professional license from the relevant authority (e.g. in Austria: Austrian Chamber of Veterinarians). PetAid only carries out a plausibility check. There is no further examination. PetAid is therefore not liable for the information provided by the doctors themselves regarding their approval or their professional qualifications.
- 4. User Contribution
4.1 It is the sole responsibility of the user to ensure that the data made available via the platform is current, correct and complete. The user is required to update and adjust his personal information and health data before booking the consultation appointment, if necessary. In addition, the user is obliged to describe complaints correctly and completely. The user is responsible for the consequences of incorrect, incomplete or outdated data.
4.2 The user must protect access to his user account from access by third parties by means of appropriate security measures. The user himself is responsible for the consequences of insufficient security measures on the part of the user, in particular misuse of his data.
- 5. Compensation
The use of the platform is free for the user. The remuneration for the consultation appointment or any cancellation costs for consultation appointments that are not canceled in good time are based on the respective treatment contract with the respective veterinarian.
- 6. Billing
The costs for the consultation appointments are billed directly by the treating veterinarian.
- 7. Privacy
With regard to data protection, PetAid’s data protection declaration applies, which can be accessed here.
- 8. Liability
8.1 The user account is managed by the user himself under his own responsibility. PetAid has no influence on the correctness, topicality and completeness of the data stored by the user. PetAid is not liable for damage resulting from outdated, incorrect or incomplete data.
8.2 PetAid only enables the user and the veterinarian to arrange an appointment for a consultation. PetAid is not liable for the implementation, compliance, timeliness and content of the consultation appointments.
8.3 The prerequisite for the full use of the services offered by PetAid via the platform is the cooperation of the user. If PetAid is unable to provide information or services in whole or in part due to the user’s lack of cooperation, PetAid will be released from the provision of the service in full or in part.
8.4 Some of the online services offered by PetAid are provided with the involvement of third-party network or service providers. The availability of the services is therefore dependent on the technical provision by the third party service provider, particularly with regard to the network services. PetAid assumes no obligation to keep the services offered uninterrupted and available on the Internet at all times. The user is aware that PetAid has no influence on the possibility of internet access, the transmission speed or the availability and stability of the network connections and accesses. In order to ensure access to the stored data even if the services fail, the patient is responsible for regularly printing out the data or saving it on an alternative storage medium.
8.5 The contractual and non-contractual liability of PetAid and its vicarious agents is limited to intent and gross negligence.
- 9. Term and Termination
9.1 The mediation contract is concluded for an indefinite period.
9.2 The user can terminate the agency contract at any time via the platform by deleting his user profile. The termination becomes effective with the deletion of the user profile. The user account and the data contained therein will be irrevocably deleted.
9.3 In addition, the user can also terminate the agency contract by letter or email to the following address:

9.4 In case of termination by letter PetAid reserves the right to take appropriate measures to verify the correct identity of the user (e.g. a confirmation request by email). If the identity of the user is clearly confirmed, PetAid will irrevocably delete the corresponding user account.
9.5 PetAid can terminate the agency contract without giving reasons by giving six weeks’ notice by letter or email. PetAid’s right to termination without notice for good cause remains unaffected. After the termination takes effect, PetAid will irrevocably delete the corresponding user account.
9.6 It is the responsibility of the user to print out the data before irrevocably deleting it or to save it on an alternative storage medium.
- 10. Modification of Terms and Conditions
10.1 PetAid is entitled to change these General Terms and Conditions. The user is entitled to terminate the contract as of the effective date of the change. The termination must reach PetAid by the time the changes come into effect at the latest.
10.2 PetAid informs the user about the forthcoming change, the user’s right of termination and the deadline to be observed either via the user account or by email at least six (6) weeks before the change takes effect.
10.3 If the user does not exercise his right of termination, the change is deemed to have been approved.
- 11. Final Provisions
Rights and obligations arising from the contract between PetAid and the user can be assigned and transferred to a third party at any time by PetAid. The user only has this right with the written consent of PetAid.
- 12. Jurisdiction and Applicable Law
Subject to a mandatory place of jurisdiction, the courts at the registered office of PetAid are responsible for all questions arising from or in connection with the General Terms and Conditions or the platform. Austrian law shall apply exclusively.

1.4 The veterinarian offers the consultation appointment and the veterinary consultation carried out during this appointment on his own behalf and under his own responsibility. PetAid itself only provides the platform for handling the consultation appointment between the user and the veterinarian. PetAid does not become a party to the treatment contract.
2. Subject matter of the contract and functioning of the platform
2.1 Before using the Platform for the first time, the Veterinarian must create a user account (“User Account”). When the veterinarian completes the registration, a user contract is concluded between the veterinarian and PetAid.
2.2 The veterinarian can use his user account to place quotas for consultation appointments online at any time and thus enable users to book via the PetAid (“booking module”).
3. Professional qualifications of veterinarians
The veterinarians prove their admission by means of a corresponding license to practice their profession from the authority responsible for the respective country of practice (e.g. in Austria: Austrian Chamber of Veterinarians). PetAid only carries out a plausibility check. There is no further examination. PetAid is therefore not liable for the information provided by the doctors themselves regarding their approval or their professional qualifications.
4. Cooperation of the veterinarian
4.1 It is the Veterinarian’s sole responsibility to ensure that the data made available via the Platform is current, correct and complete.
4.2. 4.2. The veterinarian is obliged to only accept appointment requests from users whose animals he has personally treated before (existing patients). (Or according to the legal requirements of the respective country)
4.3 The veterinarian must protect access to his user account from access by third parties by taking appropriate security measures. The veterinarian himself is responsible for the consequences of insufficient security measures on the part of the veterinarian, in particular misuse of his data.
4.4 The veterinarian is obliged to comply with the legal and professional regulations applicable in the country in which he practices his profession.
5. Compensation
The use of the platform is chargeable for the veterinarian. The amount of the remuneration for the use of the platform is calculated on the basis of the number of consultation appointments booked plus a fixed monthly fee. The costs to be borne by the user for treatment appointments or any cancellation costs for consultation appointments not canceled in good time are based on the respective treatment contract with the respective veterinarian.
All invoices to users are billed directly by the respective veterinarian.
Use as SaaS or soft white label:
The fee for PetAid is €1.00 (one euro and zero euro cents) per booked consultation appointment.
The fixed monthly fee is €79 (seventy-nine euros) per veterinary user account.
All prices are excluding VAT.
There is no monthly fee for the first month.
Use as a white label:
Both the appointment fee and the monthly fee are negotiable.
6. Billing
6.1 The vet undertakes to provide PetAid with the information required to calculate the remuneration in accordance with point 5 by the end of the respective month.
6.2 The remuneration calculated by PetAid is due for payment within 7 days of invoicing.
7. Privacy
With regard to data protection, PetAid’s data protection declaration applies, which can be accessed here.
8. Liability
8.1 The user account is managed by the veterinarian under his own responsibility. PetAid has no influence on the correctness, topicality and completeness of the data stored by the veterinarian. PetAid is not liable for damage resulting from outdated, incorrect or incomplete data.
8.2 PetAid only enables the veterinarian and the user to arrange a consultation appointment. PetAid is not liable for the implementation, compliance, timeliness and content of the consultation appointments.
8.3 A prerequisite for full use of the services offered by PetAid via the platform is the cooperation of the veterinarian. If PetAid cannot provide information or services in whole or in part due to the veterinarian’s lack of cooperation, PetAid will be released from providing the service in whole or in part.
8.4 Some of the online services offered by PetAid are provided with the involvement of third-party network or service providers. The availability of the services is therefore dependent on the technical provision by the third party service provider, particularly with regard to the network services. PetAid assumes no obligation to keep the services offered uninterrupted and available on the Internet at all times. The veterinarian is aware that PetAid has no influence on the possibility of internet access, the transmission speed or the availability and stability of the network connections and access. In order to ensure access to the stored data even if the services fail, the veterinarian himself is responsible for regularly printing out the data or saving it on an alternative storage medium.
8.5 The contractual and non-contractual liability of PetAid and its vicarious agents is limited to intent and gross negligence.
9. Term and Termination
9.1 The mediation contract is concluded for an indefinite period.
9.2 The veterinarian can terminate the mediation contract at any time with one month’s notice. PetAid will implement the termination by deleting the user profile after the deadline has expired. The user account and the data contained therein will be irrevocably deleted.
9.3 In addition, the veterinarian can also terminate the mediation contract by letter or email to the following address:

9.4 In the event of termination by letter, PetAid reserves the right to take appropriate measures to verify the correct identity of the veterinarian (e.g. a confirmation request by email). If the identity of the user is clearly confirmed, PetAid will irrevocably delete the corresponding user account.
9.5 PetAid can terminate the agency contract without giving reasons by giving six weeks’ notice by letter or email. PetAid’s right to termination without notice for good cause remains unaffected. After the termination takes effect, PetAid will irrevocably delete the corresponding user account.
9.6 It is the veterinarian’s responsibility to print out the data before irreversibly deleting it or to save it on an alternative storage medium.
9.7 During the first 30 days, the veterinarian can cancel immediately at any time.
10. Modification of Terms and Conditions
10.1 PetAid is entitled to change these General Terms and Conditions. The veterinarian is entitled to terminate the contract as of the effective date of the change. The termination must reach PetAid by the time the changes come into effect at the latest.
10.2 PetAid will inform the veterinarian of the upcoming change, the veterinarian’s right of termination and the deadline to be observed either via the user account or by email at least six (6) weeks before the change takes effect.
10.3 If the veterinarian does not exercise his right of termination, the change shall be deemed to have been approved.
11. Final Provisions
Rights and obligations arising from the contract between PetAid and the veterinarian can be assigned and transferred to a third party at any time by PetAid. The veterinarian only has this right with the written consent of PetAid.
12. Jurisdiction and Applicable Law
Subject to a mandatory place of jurisdiction, the courts at the registered office of PetAid are responsible for all questions arising from or in connection with the General Terms and Conditions or the platform. Austrian law shall apply exclusively.
